  • It’s listed as for rent and for sale. Does that mean you could rent it and get evicted 2 weeks later by the new owners? No thanks.

    • I don’t think they could kick you out until after the first year’s lease went month-to-month.
      And then they have to give you 90 days notice after the close of the sale.

      • Any landlords can evict tenants with 90 days notice if they want to move in. So it’s just a matter of whether the new owners (if the place sells) would rather have tenants or live there themselves.

        On the plus side, once you become a tenant you have the ability to buy it through TOPA.

        It is listed for $450,000. If you put 20% down, the mortgage+property taxes + homeowners’ insurance would probably be about $2050 a month. So that is clearly a better deal, especially with the mortgage interest tax deduction, but not everyone has $90k or wants to be a homeowner.

      • I’m pretty sure you cannot force someone to break a lease merely because you want to move in. You could offer to buy them out of it, of course. You can give them 90 days notice toward the end of the lease which would give you a better leg up if they tried to hold over (you can sue for double rent during the holdover period).
