“Attorney General Brian L. Schwalb today announced that the Office of the Attorney General (OAG) has secured a $259,294 judgment against Michael Redmond, a former assistant principal at Stephen E. Kramer Middle School in Ward 8, for defrauding the District by taking a full-time, in-person job in Rhode Island while he was supposed to be working remotely for the DC Public Schools (DCPS). The court determined that Redmond “engaged in conduct that showed a willful disregard for the truth and a willingness to engage in defrauding the District of Columbia,” knowingly collecting more than $45,000 of his DCPS salary for work he did not complete. The court imposed treble damages and civil penalties for violating the District’s False Claims Act. (more…)

Schwalb today announced successful outcomes in two separate appellate cases in which the District sought to hold landlords and developers accountable for harm they caused to DC residents. In one case, the Office of the Attorney General (OAG) secured a decision upholding a Department of Buildings order that requires a developer to fix faulty construction that caused a Ward 4 condo building to sway in the wind, endangering unit owners and the community. In another case, OAG won a decision upholding the validity of rent refunds for 2,500 tenants at Marbury Plaza (now re-named Langston Views), a Ward 8 apartment building where landlords severely neglected the building, endangered residents, and refused to make court-ordered repairs. “Continuing his focus on holding dangerous drivers accountable for repeated, illegal conduct on DC streets, Attorney General Brian L. Schwalb today announced four new lawsuits, including three lawsuits against Maryland drivers and one lawsuit against a Virginia driver who have amassed more than 1,000 traffic infractions among them. The vast majority of the citations accumulated by the four defendants were for excessive speeding, and in total, the drivers owe the District more than $340,000 in unpaid fines, penalties, and fees. Schwalb today issued a Consumer Alert to customers of the genetic testing company 23AndMe, warning District residents that their genetic data may be at risk after the company declared bankruptcy this week. While the company states that there will be no change to the storage, management, or protection of customer data, it is important to protect your sensitive genetic data from risk. Schwalb today announced a lawsuit against GoBrands, Inc. and GB Logistics, LLC (collectively “Gopuff”), the companies behind the popular delivery service Gopuff, for illegally failing to pay its delivery workers minimum wage, overtime, and paid sick leave by misclassifying them as independent contractors rather than employees. The complaint filed by the Office of the Attorney General (OAG) also alleges that, with its misclassification scheme, Gopuff is deliberately dodging its legal obligations to pay into the District’s unemployment insurance and paid family leave programs and failing to maintain workers’ compensation coverage. Schwalb announced that Office of the Attorney General (OAG) successfully resolved seven investigations into employers suspected of violating DC laws protecting DC workers and key workplace rights. Under the terms of seven separate settlement agreements, these employers—including American University, VIDA Fitness, Insomnia Cookies, a medical staffing firm, a translation company, a café, and a dinner theater—will pay more than $860,000 to harmed workers and the District, and have agreed to reform their workplace practices.
