A reader reports:

“This order was filed in the DC district court May 5 (see below for full PDF). Seems the Dunkin’ Donuts at 14th and U is at risk of losing its franchise for allegedly not paying franchise fees. My question/concern is: if Dunkin’ terminated the franchise agreement last month, but the place is still open, where on earth are the owners currently getting their donuts from?!”

Dunkin Donuts lawsuit (PDF)

Plaintiff Dunkin’ Donuts Franchising, LLC (“Dunkin’ Donuts”) brings this action against 14th Street Eatery, Inc., Mohammad Hoque, and Yasmin Parveen (collectively, the “Defendants”) for breach of contract and trademark infringement. Dunkin’ Donuts alleges that Defendants failed to pay franchise and other fees, and as a result Dunkin’ Donuts terminated the franchise agreement between the parties. Despite this termination, Defendants continue to operate an eatery holding itself out as a Dunkin’ Donuts franchise, thereby infringing Dunkin’ Donuts’ trademarks and violating the terms of a covenant not to compete. Before the Court is Dunkin’ Donuts’ motion for a preliminary injunction, which Defendants have failed to oppose. Upon consideration of the uncontested motion, the entire record, and for the following reasons, the motion is granted.

For the foregoing reasons, Dunkin’ Donuts’ Motion for a Preliminary Injunction is granted. Defendants are enjoined during the pendency of this matter from using Dunkin’ Donuts’ trademarks or operating a competing business within a five mile radius of the former franchise. Within 30 days, Defendants must file with the court a report in writing under oath setting forth in detail the manner and form in which the defendant has complied with the injunction.

Lots of readers have been writing in about the closed/suspended Dunkin Donuts (and Subway) at 14th and U St, NW. On Friday we learned they had closed due to tax issues.

In more positive Dunkin news – for those that work downtown – you’re getting a new double-wide one at 12th and G on G Street across from Macy’s:

Dear PoPville,

Went by Dunkin Donuts Friday morning at 14th and U. It was closed by the DC Health Department for “imminent” dangers associated with their food service. Any idea what was going on there? The owners posted a “Sorry, we’re closed” sign as well. Didn’t know if you had any details.

Thanks to all who sent emails. Not sure what happened but I walked by on Sunday and they had already reopened:

“Dear PoPville,

The new Dunkin’ Donuts on 14th and U St is NOW OPEN! I pass it every day, and I have been waiting months for it to open up. According to the notices that have been on their windows, they’d been training their staff for quite some time. So I was delighted to see that it was open this morning. The staff is super nice, but you can tell they’re still brand-spanking new and so are just a bit slow (they’re still learning).

And I think there is a special going on? I was running to catch the circulator, so I didn’t stay to find out what it was. But I bought a medium coffee and a flatbread sandwich and I only paid $3.05! So I think maybe the coffee’s free with purchase of a sandwich or something?

In any case, I’m happy Dunkin’ Donuts is in the neighborhood.”

This can be a pretty divisive topic – but I’m with you – this makes me very happy.

14th and U Street, NW

Thanks to Abram for passing on the scuttlebutt:

“Just got word from one of the employees that the Dunkin’ Donuts at 14th and U street NW will also close on December 29th! First Columbia Heights, now U street! It’s a 14th street Donut massacre! Oh well, I guess another one bites the dust.”

Dunkin Donuts opened at 14th and U Street back in October 2011. STAY TUNED.
