Arrest Made in Assault with Deadly Weapon of Juvenile: 600 Block of T Street, NW

From MPD:

“At approximately 8:40 Tuesday evening, a juvenile male was walking in the 600 block of T Street, NW, when he and adult male suspect began to argue. During the argument, the adult male suspect produced a knife and stabbed the juvenile multiple times to his body while two other adult suspects (male and female) held the juvenile. All three suspects were stopped in the 1800 of block of 7th Street, NW. The suspects were positively identified by the victim and witnesses. Subsequently, the suspects were placed under arrest and charged with Assault with a Deadly Weapon (ADW).

The victim was transported to a nearby hospital where he was admitted.”

    How is this not attempted murder? No premeditation?

      Premeditation is when someone early came up with a plan to try to attack/kill someone. Probably not the case here, but I hope they go with attempted murder and maybe (if necessary) plead down to Attack with a deadly weapon.

      I think we don’t need more people in jail, but violent people like this – hell yeah, throw them in jail for a long time!

      I’m not an expert on criminal law, but it’s possible the suspect(s) will still be charged with attempted murder. The police only need one charge to hold them in custody while the U.S. Attorneys Office puts together the case against them. The assault charge should be enough to keep them behind bars pending trial/plea hearing by which point the prosecutor may have added other charges to the indictment.

      Premeditation, a well thought out plan in the legal world, is not needed to prove attempted murder. An intent to kill is. This intent can be formed on the spur of the moment, and can be proven using circumstantial evidence i.e., you don’t need someone to say “i intend to kill you” in order to prove this portion of the charge. In D.C. what you generally think of as attempted murder is generally charged under D.C. Code 22-401; assault with intent to kill.

    Let’s keep that progress coming in this area! One day, activities like these will be a thing of the past. Or as some like to say “back in the day”.

    Whaaaaaaa????? It’s bad enough that a kid got stabbed, but who thinks it’s OK to hold someone down while this happens? Glad all three were arrested. #propstocops

    Ages would be helpful here. If it’s a 17-year-old and 19-year-old who knew each other already it’s in fact different than a 10-year-old and 30-year-old who are strangers. (Obviously it’s not even close to okay regardless of ages, prior relationship, etc. but more context would be helpful here.)
